In these Terms and Conditions "we" and "us" mean Mega Boutique Pty Ltd ABN 65 611 611 100, and "you" means you the customer. These Terms and Conditions together with your Order constitute the entire Contract between us and you for the supply of Products. The Contract cannot be varied unless we agree to vary it in writing or by email. We presently sell and ship Products only within Australia. We are not able to make deliveries outside of Australia.

PLACING AN ORDER WITH MEGA BOUTIQUE

You may place an Order by filling in the Order Form on the Mega Boutique Web Site and clicking the "Confirm Order" button. When you place your Order, we will issue you with an Order Number via email. By placing an Order, you make an offer to us to purchase the Products you have selected based on these Terms and Conditions. Please note that the images on the website are indicative only. We try our best to ensure accuracy. We will notify you that your order is being processed by sending you an Order Confirmation and tax invoice via email; however, we do not formally accept your offer until your order has passed our internal validation procedures for verifying the bona fides of each order placed, for the purpose of preventing credit card or payment fraud. Mega Boutique and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion. We will confirm acceptance of your order when we send you an email confirming shipment of the goods you have ordered. If we cannot process or accept your Order after payment is received we will contact you by email or telephone.

Most products that we offer for sale are in stock and are usually dispatched within 24 hours. However, we do have some items that are in stock at supplier and for such item, it will take between 5 to 10 business days for us to receive stock. If your order is a mix of in stock and in stock at supplier items, your order will only be fulfilled when all stock has been received.

PAYMENT METHODS AND ACCEPTANCE

Mega Boutique currently accepts PayPal, Visa, MasterCard and Direct Deposit only. Payment processing will not begin until we receive all the information we need. Orders placed on a weekend or a Public holiday will not begin payment processing until the next business day. Business days are Monday through Friday, excluding state and federal public holidays. If a Direct Deposit payment is not received within 7 days from the date that you receive your Order Confirmation, Mega Boutique reserves the right to cancel the transaction.

PRICES

Mega Boutique always seeks to list Products with the most competitive prices. Mega Boutique reserves the right to change prices for Products displayed at Mega Boutique at any time before you place an Order. The price of products shown excludes shipping costs. Shipping costs are shown separately on the product page but may be recalculated based on how many and what items you place in your shopping cart.

WARRANTY AND RETURNS

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. In addition to the rights and remedies you may have under the Australian Consumer Law you may also be entitled to benefits under the terms of any additional manufacturer's warranty. The manufacturer's warranty (if it applies to your product) does not in any way affect your rights under the Australian Consumer Law.

FORCE MAJEURE

To the extent permitted by law, Mega Boutique is not liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of Mega Boutique, and Mega Boutique shall be entitled to a reasonable extension of time for the performance of such obligations.

GOVERNING LAW

By placing an order with Mega Boutique you agree that the sale is made in the state of Victoria, Australia. These Terms and Conditions shall be governed by and construed in accordance with the laws of Victoria and shall be subject to the non-exclusive jurisdiction of the courts of Victoria.

Purchase of Alcohol

Mega Boutique supports the responsible service of alcohol. It is an offence to supply alcohol to or obtain alcohol on behalf of a person under the age of 18 years. Liquor Licence 36164810.

If ordering hampers containing alcohol, you confirm that you are over the age of 18 years. It is a legal requirement that the person placing the order is over the age of 18 and the person receiving the delivery is over the age of 18.

Under the Liquor Control Reform Act 1998 it is an offence to supply alcohol to a person under the age of 18 years (Penalty exceeds $17,000). For a person under the age of 18 years to purchase or receive liquor. (Penalty exceeds $700)
